Intellectual Property Rights (IPR) Protection

U.S. negotiators will strive to secure South Korean agreement to strengthen enforcement of intellectual property rights, including controls over unauthorized online transmission and distribution of copyrighted works, the seizure of pirated goods and equipment to make and transmit pirated goods, and proper compensation to victims of IPR violations. The U.S. business community has targeted specific Korean policies and practices in intellectual property issues. For example, the Korean Food and Drug Administration (KFDA) requires that proprietary data on pharmaceutical manufacturing processes be submitted for new drugs; in addition, the South Korean government has, in some cases, approved marketing of some pharmaceuticals before it has determined that the applicant is the rightful owner of the patent and trademark. The USTR has continued to place South Korea on the special 301“Watch List.” The USTR indicated that the South Korean government has strengthened its enforcement of copyright laws but still needs to go further.
