한미 FTA 저지 지적재산권 분야 대책위원회

1. 첨부 문서의 배경 : 미국 통상정책과 민간 자문위원회

• 미국 헌법은 대외통상에 관한 권한과 관세․조세를 부과할 권한을 의회에 부여하고 있는데, 미국 의회가 자신의 권한 행사를 위해 행정부에게 배치한 조직이 바로 USTR이다.

• USTR은 통상정책을 수립할 때 반드시 민간의 의견을 들어야 하는데, 미국 의회의 관심사항과 입장이 통상협상 과정에서 효과적으로 반영될 수 있도록 하기 위해 민간 자문위원회를 구성하도록 통상법에 명문화 하였다(1974년 미국 통상법에서 제정하여 2002년 통상법에서는 민간 자문위원회를 더욱 더 강화하였음).

• 2002년 통상법에 따르면, 민간자문위원회는 3개 층위로 구성되어 있다.

- 최상층은 대통령 직속의 통상정책 및 협상자문위원회(ACTPN; President's Advisory Committee for Trade Policy and Negotiations). 현재 ACTPN 위원들의 명단은 http://www.ustr.gov/assets/Who_We_Are/Advisory_Committee_Lists/asset_upload_file346_5865.pdf 참조.

- ACPTN 아래에는 4개의 정책자문위원회(PAC: Policy Advisory Committee)가 있다. (1) IGPAC (Intergovernmental Policy Advisory Committee), (2) APAC (Agricultural Policy Advisory Committee), (3) LAC (Labor Advisory Committee), (4) TEPAC (Trade and Environment Policy Advisory Committee).

- 3번째 층위에는 22개의 기술별/부문별 자문위원회가 있다. 기술별/부문별 자문위원회는 산업과 농업 2개의 분야로 나누어 구성(ATAC: Agricultural Technical Advisory Committee, ITAC(Industry Trade Advisory Committee))되어 있다. 이 가운데, 지적재산권 문제에 관해 세부적이고 전문적인 조언을 하는 곳은 ITAC 15이며, 의약품 분야는 ITAC 3이 담당하고 있다(ITAC 3 위원 명단은 별첨자료 참조).

• 현재 미국의 민간 자문위원회는 위 3개 층으로 구성된 자문위원회에 포함된 위원만 약 700명에 이르며, 이들 위원 중에는 회원사가 수천 개에 달하는 협회 소속 위원들이 포함되어 있고, 학계와 공익단체 역시 포함되어 있다.

2. 첨부 문서의 성격 및 주요 내용

• 한미FTA 1차 본 협상을 앞두고 한미 양국은 2006년 5월 20일 협정문 초안을 교환했다. 본 공개 문서는 미국내 수 백개 기업들의 연합체로 구성된 모 협회가 협정문 초안을 교환하기 11일 전인 2006년 5월 9일에 ITAC 3에 제출한 의견서이다.

• 의견서의 형식으로 구성되어 있는 본 공개 문서의 주요 내용은 “의약품 허가를 위해 제출한 자료의 독점권(5-year Market Exclusivity, 3-year Market Exclusivity), 특허기간 연장, 의약품 허가 과정의 특허 연계 등”에 대한 것이다.

• 본 공개 문서의 의견에는 막연하게 한미FTA에 어떤 사항이 포함되어야 한다는 의견을 제시하는 수준이 아니라, 구체적으로 미국 측이 만든 한미FTA 협정문 초안의 특정 조항의 문구 수정까지 제안하고 있다.

예를 들면, 의견서에는 “미국-한국 FTA 협정문에 대한 몇 가지 수정을 제안한다 (recommends several modifications to the text of the U.S.-Korea FTA)”고 하면서, 지적재산권 장 제9조의 “동일 또는 유사 품목(same or similar products)”에서 “유사 품목”이란 표현은 삭제해야 한다고 주장하거나, 제8조의 (7)(a)-(b)항은 특허기간 연장을 최대 5년으로 제한해야 한다(“Article 8, subsection (7)(a)-(b) limit patent extensions to no more than 5 years)”고 제안하고 있다.

• 이는 본 공개 문서를 작성한 협회가 미국 측이 준비한 한미FTA 협정문 초안 전체를 보았다는 사실을 의미한다. 더구나 이 협회는 ITAC 3 위원회의 정식 회원도 아니다. 요컨대, 미국 측은 한국 정부와 협상단의 그 동안 주장과는 달리, 광범위한 민간 자문위원회를 운영하면서 관련 분야의 이해당사자들에게 협정문 초안의 내용을 있는 그대로 공개하고 있다.

• 따라서 본 공개 문서는 한국 정부와 협상단이 그 동안 협상문 공개를 기피하면서, 그 근거로 제시했던 해외 사례 및 미국의 상황 등에 대한 주장이 명백한 거짓이었음을 확인시켜주는 구체적인 증거이다.

한미FTA와 관련하여 한국 정부와 협상단이 국민, 국회, 언론 등을 우롱하며 거짓말과 정치적 선전만을 반복하고 있다는 사실이 다시 한번 공개적으로 확인된 셈이다.
